Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mark8IQ platform and associated services ("Services") provided by Infytrix Business Solutions FZCO, Trade Licence No. 78863, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, UAE ("Infytrix", "we", "us").

By accessing our website, requesting a demo, or subscribing to our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

Infytrix provides the Mark8IQ suite — a unified commerce intelligence platform comprising five modules: Mark8Ads, Mark8Sights, Mark8Shelf, Mark8Reco, and Mark8Returns. The specific modules available to you depend on your subscription plan.

We reserve the right to modify, update, or discontinue any feature or module of the Services with reasonable prior notice. We will endeavour to provide at least 30 days' notice for material changes that affect core functionality.

To access the Mark8IQ platform, you must create an account using accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

• You must notify us immediately of any unauthorised use of your account
• You may not share account credentials with unauthorised users
• Each subscription covers the number of users specified in your plan
• We reserve the right to suspend accounts that breach these Terms

Mark8IQ is offered on a subscription basis. Pricing is provided upon enquiry and confirmed in your subscription agreement. All prices are in AED unless otherwise agreed in writing.

Subscriptions renew automatically unless cancelled with at least 30 days' written notice before the renewal date. Refunds are not provided for partial subscription periods except where required by UAE consumer protection law.

We reserve the right to update pricing with 60 days' notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

Certain Mark8IQ features require you to grant us access to your marketplace accounts via authorised API programmes. By granting such access, you confirm that:

• You are the authorised account holder or have authority to grant access on behalf of the account holder
• You understand which data scopes you are authorising
• You may revoke access at any time through your marketplace account settings
• Revoking access will disable features dependent on that data connection

We access marketplace data solely to deliver your subscribed Services and in strict compliance with each marketplace platform's developer policies and UAE data protection law.

All intellectual property rights in the Mark8IQ platform — including software, algorithms, UI designs, documentation, and branding — are owned by or licensed to Infytrix Business Solutions FZCO.

Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Services for your internal business purposes only. You may not copy, modify, reverse engineer, or distribute any part of the platform without our express written consent.

Your data remains your property. We do not claim ownership of any data you input into or generate through the platform.

You agree not to use the Services in any way that:

• Violates any applicable UAE or international law or regulation
• Infringes the intellectual property rights of Infytrix or any third party
• Attempts to gain unauthorised access to our systems or data
• Introduces malicious code or disrupts the platform's operation
• Misrepresents your identity or affiliation in connection with the Services
• Uses the platform to facilitate fraudulent marketplace activity

Breach of these acceptable use requirements may result in immediate suspension or termination of your account.

To the maximum extent permitted by UAE law, Infytrix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including loss of profits, revenue, data, or business opportunity.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under UAE law.

Either party may terminate the subscription with 30 days' written notice. We may terminate or suspend your access immediately if you materially breach these Terms and fail to remedy the breach within 14 days of written notice.

Upon termination, your access to the platform will cease. We will retain your data for 30 days following termination, during which you may request an export. After 30 days, data will be securely deleted in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, specifically the laws applicable in the Emirate of Dubai.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless otherwise agreed in writing between the parties.
